Terms and Conditions for Hot Tubs Ontario

Welcome to https://hottubsontario.com/ (the “Site”), operated by Hot Tubs Ontario, a division of International Pool & Spa Centers (“we,” “us,” or “our”). By accessing or using our Site, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Site.
1. Use of the Site
1.1 Eligibility: You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you have the legal capacity to enter into these Terms.
1.2 Permitted Use: The Site is intended for personal and non-commercial use to browse, purchase, or inquire about hot tubs, swim spas, and related services. You may not use the Site for any unlawful purpose or in any way that violates these Terms.

3. Purchases and Services

3.2 Pricing and Payment: All prices are in Canadian dollars (CAD) unless otherwise stated. Payment must be made in full at the time of purchase unless financing options are agreed upon. Additional costs, such as delivery or installation, will be clearly communicated.

6. Dispute Resolution
6.1 Governing Law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
6.2 Arbitration: Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in Toronto, Ontario, on an individual basis, in accordance with the rules of the Canadian Arbitration Association. You waive the right to participate in class action lawsuits.
6.3 Jurisdiction: If arbitration is not applicable, any legal action shall be brought exclusively in the courts of Toronto, Ontario.
7. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site constitutes acceptance of the revised Terms.
8. Termination
We may suspend or terminate your access to the Site at our discretion if you violate these Terms or engage in conduct that we deem harmful to our business or other users.

10. Miscellaneous
10.1 Entire Agreement: These Terms, along with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Hot Tubs Ontario regarding the use of the Site.
10.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.3 No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
